Overview

Eligibility
You must be able to form a binding contract to use nominal products. By creating an account, you represent that you meet this requirement and that any information you provide is accurate.
Accounts
You are responsible for maintaining the security of your obex identity and any credentials linked to it, and for all activity that occurs under your account, including actions taken through connected integrations.
Acceptable Use
You may not use nominal products to violate applicable law, abuse shared infrastructure, attempt to bypass usage limits or billing, interfere with other users' workloads, or circumvent the permissions granted through obex.
Third-Party Applications
nominal allows third-party developers to build and operate applications on the platform. If you use such an application, you are also bound by that app owner's own terms and policies where applicable. nominal is not responsible for the conduct, content, or practices of third-party app owners, and we do not guarantee the availability, security, or quality of apps we did not build ourselves.
Third-Party Integrations
Certain features are delivered through third-party integrations, such as Discord bots. Use of these integrations may be subject to the third party's own terms of service, in addition to these terms. We are not responsible for the availability or behavior of services we do not operate.
Subscriptions & Billing
Payments are processed through hermes using Stripe and PayPal. Recurring subscriptions, usage-based charges, and applicable tax are governed by the billing configuration you set up. Fees are non-refundable except where required by law or explicitly stated otherwise.
Infrastructure Data & Logs
Operating your workloads on nominal generates container logs, machine logs, and infrastructure usage data. We may access and use this data to provide the service, ensure platform stability and security, provide support, and enforce these terms, as further described in our Privacy Policy.
Self-Hosting License
Self-hosted deployments of kinesis or archon are licensed for use on hardware you own or control, subject to the terms of the applicable open-source or commercial license.
Intellectual Property
nominal and its products, logos, and branding are owned by us or our licensors. These terms do not grant you any rights to our intellectual property except as needed to use the platform as intended. You retain ownership of content and code you deploy on the platform.
Suspension & Termination
We may suspend or terminate your access to nominal products if you violate these terms, misuse shared infrastructure, or fail to pay applicable fees. You may stop using the platform and close your account at any time.
Disclaimers
nominal products are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
Limitation of Liability
To the extent permitted by law, nominal is not liable for indirect, incidental, or consequential damages arising from use of the platform, including damages arising from third-party applications or integrations.
Governing Law
These terms are governed by the laws of the jurisdiction in which nominal is incorporated, without regard to conflict-of-law principles, unless otherwise required by applicable local law.
Changes to Terms
We may update these terms from time to time. Material changes will be communicated through our Discord.
